Reese Witherspoon has officially filed for divorce from her husband Jim Toth after 12 years of marriage, citing irreconcilable differences as the reason for their split.
According to Davidson County court records obtained by TMZ, Witherspoon had filed the papers in Nashville, Tennessee.
The couple, who share 10-year-old son Tennessee, will have to register for a parenting class as mandated in Davidson County and will then have 60 days to submit a certificate of completion to the court.
Witherspoon, 47, and Toth, 52, had a prenuptial agreement in place, which was signed in March 2011, which is valid and will provide "adequate and sufficient provisions" for their assets and debts.
Witherspoon is reportedly set to submit their prenup to the judge for approval as well as a permanent parenting plan.
The couple got together at the start of 2010, announcing their engagement in December of the same year, before marrying in March 2011.
Witherspoon had announced her split from her talent agent husband on March 24, days shy of the couple's 12th wedding anniversary.
The Cruel Intentions actress shared a statement on Instagram, telling fans: "We have some personal news to share... It is with a great deal of care and consideration that we have made the difficult decision to divorce.
"We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together.
"Our biggest priority is our son and our entire family as we navigate this next chapter. These matters are never easy and are extremely personal. We truly appreciate everyone's respect for our family's privacy at this time."
As well as her son Tennessee, Witherspoon is also a mother to daughter Ava, 23, and son Deacon, 19, who she shares with ex-husband Ryan Phillippe.
According to reports from Page Six, Witherspoon and Toth had decided to end their relationship after finding their marriage had become "platonic".
A source told the publication: "There’s no big scandal or drama, just two people who essentially became co-parents and don’t really have any romantic feelings for each other anymore."
An insider added to People: "They've been spending less and less time together while she was working," adding that Witherspoon is "headstrong and focused" while Toth is more "laid-back".
They added that Witherspoon "has her hand in a lot of pots" while Toth "prefers less frenzy."
Witherspoon had shared a tribute to Toth in March 2021 to mark the 10-year anniversary of their wedding, writing at the time: "What a special day with all of our dear friends. Looking back, I can’t believe it has gone so quickly!
"I guess that’s how it goes with 3 kids, Big LOVE, lots of laughing, non- stop travel, so many dogs, and fun adventures… figuring out this crazy world together. Here’s to many more days in the sun! I [love] you, JT."
